REQUEST FOR COMPETITIVE SEALED PROPOSALS

Sealed proposals are requested by the San Antonio Water System for the installation of backup power generation equipment and related site and electrical improvements at fifteen (15) production facility sites for the Emergency Preparedness Plan Implementation Natural Gas Generator Equipment Installation (the “Project”). The backup generators and associated electrical gear have been procured through a separate Procurement Contract and will be contractually assigned by SAWS to the selected Respondent.

To register as a SAWS vendor, visit our website located at www.saws.org and click on the Business Center. Then select Bidder, Consultant, and Vendor Registration, which is located on the left-hand side of the screen. Select the Register Now button and proceed with registration.

Due to the confidential nature of this work, in order to be eligible to receive a copy of the Plans and Specifications that accompany this Request for Competitive Sealed Proposal (RFCSP), potential Respondents serving as the general contractor must submit a prequalification form and an executed nondisclosure agreement in the form attached hereto as Exhibit C (“Firm NDA”). Additionally, all electrical subcontractors must also submit a separate prequalification form and executed Firm NDA in order to directly be eligible to receive the Plans and Specifications. SAWS will evaluate and respond within two (2) business days regarding the acceptability of the prequalification form(s). SAWS will distribute the Plans and Specifications no earlier than September 29, 2023, only to those Respondents and electrical subcontractors who will meet the prequalification requirements and submit an executed Firm NDA. Prequalification forms must be submitted no later than 12:00 PM (CDT) October 10, 2023 4:00 PM (CDT) October 6, 2023.

The Respondents will be responsible to distribute the Plans and Specifications to their respective teams. Prequalified Respondents and all subcontractors will be responsible for maintaining the confidentiality of this project per the terms of the Firm NDA. Prior to distributing any portion of the Plans and Specifications, a fully completed Firm NDA must be obtained from all tiers of subcontractors and suppliers and provided to SAWS. SAWS will maintain a public list of those subcontractors and suppliers with Firm NDAs that will be posted to view on the SAWS website. It is recommended Respondents and all subcontractors facilitate receipt of as many of these Firm NDAs as possible in advance of SAWS distribution of the Plans and Specifications.

A mandatory in-person pre-proposal meeting will be held at 2:00 PM (CDT) October 10, 2023, at the San Antonio Water System’s Customer Service Building, 1st Floor, Conference Room CR-C145, 2800 U.S. Hwy 281 North, San Antonio, Texas 78212. Please be advised that at least one (1) member of the prequalified Respondent must be in attendance and under no circumstances shall any late or non-attendee to the mandatory pre-proposal meeting be allowed to submit a Proposal for the project. Prequalified electrical subcontractors may also attend but is not mandatory. A maximum of three (3) members per prequalified Respondent or electrical subcontractor will be allowed to attend. Respondents may elect to include other potential subcontractors as attendees but will count toward the total maximum of three (3) members per Respondent. Each attendee who will attend the pre-proposal meeting shall have submitted a fully completed individual NDA to SAWS in the form attached hereto as Exhibit D (“Individual NDA”) no later than one (1) business day in advance of the meeting. Attendees not meeting these requirements will not be permitted to attend the pre-proposal meeting.

A non-mandatory site visit to three (3) of the project sites will be conducted at 8:00 AM (CDT) October 12, 2023. Additional details will be provided during the mandatory pre-proposal meeting. A maximum of three (3) members per prequalified Respondent or electrical subcontractor will be allowed to attend the non-mandatory site visits. Attendees may include other subcontractors but will count toward the total maximum of three (3) members per Respondent. Each team member who will attend the site visit shall have submitted a fully completed Individual NDA at least one (1) business day in advance of the site visit. Attendees not meeting these requirements will not be permitted to attend the site visit. 

Please note the prequalification of electrical subcontractors is only to receive the Plans and Specifications, attend the pre-proposal meeting, and/or the site visit. It is NOT a requirement for inclusion of a prequalified electrical subcontractor as part of a Respondent’s Proposal.

Answers to the questions will be distributed to pre-qualified Respondent’s by 4:00 PM (CST) on November 6, 2023, 4:00 PM (CDT) on October 25, 2023 as a separate document or included as part of an addendum. Be advised that firms responding to this RFCSP (Respondents) are prohibited from communicating with any other SAWS staff, the Consultant, or COSA officials regarding this RFCSP up until the contract is awarded.

Proposals will be received electronically only, until 10:00 AM (CST), November 14, 2023. 2:00 PM (CDT), October 30, 2023. Electronic proposals will be received via the secure SAWS FTP site. Reference the Electronic Proposal Opening Instructions attachment for additional information regarding an electronic proposal submittal. Electronic proposals shall be accompanied by a bid bond in an amount not less than five percent of the total proposal price. (Or, if providing SAWS with a cashier's check or certified check in an amount not less than five percent of the total proposal price, SAWS will request this within 24 hours from the Respondent who did not submit a bid bond). Proposals will then be publicly opened and read aloud by Contract Administration via WebEx.

Respondents will need to submit a request no later than 10:00 AM (CST) on November 9, 2023, October 29, 2023 by 4:00 PM (CDT) to receive access to the File Transfer Protocol (FTP) site via email to Lindsay.Esquivel@saws.org. Respondent’s email requesting access to the FTP site shall provide the legal name of the Respondent’s company and the intended recipient’s email address and phone number. No requests for FTP site access will be accepted after 10:00 AM (CST) on November 9, 2023, October 29, 2023 by 4:00 PM (CDT). 

This solicitation requires a Qualification Package, Good Faith Effort Plan, and Conflict of Interest Questionnaire, which should be included as part of the proposals and will become part of the construction documents.
